The Zakarpattia District Administrative Court has opened proceedings in a case concerning the protection of the Grofa Landscape Reserve, a protected area of national importance located in Ivano-Frankivsk Oblast, western Ukraine.
The lawsuit was filed by the Ivano-Frankivsk Regional Prosecutor's Office, which seeks to have the court recognize the inaction of the State Specialized Enterprise Forests of Ukraine, represented by its Carpathian Forest Office Branch, as unlawful. The prosecutors also request that the enterprise be required to prepare and approve a land management project and officially establish the reserve's boundaries on the ground.
The Grofa Landscape Reserve, covering 2,533.8 hectares, was established in 1996 to protect unique stone pine and spruce old-growth forests, the characteristic mountain landscapes of the Prylimnytski Gorgany, and habitats of numerous rare and endangered species.
The reserve encompasses the upper reaches of the Limnytsia River and the Grofa Mountain area, one of the best-known peaks of the Gorgany mountain range.
The area preserves valuable natural ecosystems as well as glacial landforms, including cirques and moraine ridges.
Reserve Boundaries Have Not Been Officially Established for Nearly 30 Years
According to the Prosecutor's Office, despite the reserve having been established almost three decades ago, no land management project has been prepared and the protected area's boundaries have never been officially demarcated on the ground.
The absence of legally established boundaries increases the risk of encroachment, complicates land management and enforcement, and may threaten the integrity of valuable ecosystems and protected habitats.
The Prosecutor's Office emphasizes that responsibility for ensuring the proper protection and conservation of the reserve rests with its land user, the Carpathian Forest Office Branch of the State Specialized Enterprise "Forests of Ukraine".
The opening of court proceedings does not constitute a final judicial decision. The court will examine the merits of the case and determine whether the enterprise's failure to establish the reserve's boundaries constitutes unlawful inaction.
